these terms govern your use of myddpc.com, app.myddpc.com, the ddpc native mobile applications including ddpc-connect, and any related services (together, the "services"), operated by ddpc ("we", "us", or "ddpc"). by creating an account or using the services, you agree to these terms. if you do not agree, do not use the services.

these terms work together with our privacy policy.

1. account

you must be at least 13 years old to create an account. you are responsible for the accuracy of the information you provide, for keeping your password secret, and for everything that happens under your account. notify us right away at myddpc@gmail.com if you believe your account has been used without your permission.

2. subscriptions

ddpc (free)

the core ddpc service, including vehicle records, maintenance log, fuel tracking, parts tracking, photo documentation, receipt scanner, health score, and data export, is free to use for as long as you keep your account.

garage keep (pro)

garage keep is a paid subscription that adds the ai assistant, proactive alerts, cloud sync for ddpc-connect trip logs, and related features. it is offered at $14.99 per month or $149 per year. subscriptions renew automatically at the end of each billing period until you cancel. you can cancel at any time from account settings. cancellation takes effect at the end of the current billing period. you keep access to garage keep until that date, after which your account reverts to the free tier. your data stays with you.

new accounts receive a 30-day free trial of garage keep without a credit card requirement. at the end of the trial, garage keep features pause unless you subscribe. the trial may be extended by completing activation milestones as offered in-app.

refunds

monthly garage keep subscriptions are non-refundable. annual garage keep subscriptions are refundable on a pro-rated basis within 14 days of initial purchase. after those windows, fees already charged are non-refundable, except where applicable law requires otherwise.

price changes

we may change the price of garage keep. we will give you at least 30 days' notice by email before a price change takes effect on your subscription.

payment processor

payments are processed by stripe. use of stripe is subject to stripe's own terms and privacy policy.

3. your content

the vehicle records, maintenance entries, photos, notes, and everything else you add to ddpc are yours. you keep ownership of it. you grant ddpc a limited license to store, display, and process that content as needed to operate the services for you. if you opt in to aggregate data sharing, you grant ddpc a non-exclusive license to include a de-identified, aggregated representation of that data in datasets we make available to industry partners, researchers, or regulators.

4. acceptable use

do not do any of the following:

use the services to break any law or violate anyone's rights.
upload malware, spam, or deceptive content.
probe, scan, or test the vulnerability of the services without prior written permission.
attempt to bypass paywalls, trial restrictions, or access controls.
scrape the services or use automated means to collect data beyond what our public api permits.
impersonate anyone else or create accounts on behalf of others without authorization.
resell the services to third parties without a written agreement with us.

5. intellectual property

ddpc, the ddpc logo, the garage keep name, ddpc-connect, ddsr, and all associated software, designs, and content (other than user content) are owned by ddpc and protected by intellectual property laws. we grant you a limited, non-exclusive, non-transferable, revocable license to use the services for their intended purpose. nothing in these terms transfers ownership of our intellectual property to you.

6. hardware disclaimer (ddpc-connect)

ddpc-connect reads data from a vehicle's on-board diagnostic port using third-party hardware adapters. we do not manufacture those adapters. you are responsible for using compatible, safe hardware and for understanding your vehicle. do not operate the app or insert an adapter while driving. the app is a diagnostic tool, not a repair authority. do not rely on it for safety-critical decisions without independent verification. we are not responsible for damage to vehicles, adapters, or phones caused by misuse.

7. ai features

garage keep includes ai-generated content. ai output is generated by machine-learning models and may be incorrect, incomplete, or out of date. treat ai output as a starting point, not a conclusion. do not rely on ai output alone for decisions that affect vehicle safety, your finances, or your health. we are not liable for decisions made on the basis of ai output.

8. third-party services

the services integrate with third-party products (stripe, supabase, google, and others). your use of those products is subject to their own terms and privacy policies. we are not responsible for third-party services.

9. termination

you can delete your account at any time from account settings. we may suspend or terminate your access to the services if you violate these terms, if your payment fails and is not cured, or if we are required to do so by law. if we terminate your account for a material violation, fees already charged are non-refundable. if we terminate your account for any other reason, we will issue a pro-rated refund of prepaid fees.

10. disclaimers

the services are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. we do not warrant that the services will be uninterrupted, error-free, or secure, or that defects will be corrected, or that ai and anomaly-detection output will be accurate or complete.

11. limitation of liability

to the maximum extent permitted by law, ddpc will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to the services. our total liability for any claim arising out of or related to the services is limited to the greater of one hundred dollars ($100) or the amount you paid us in the twelve months before the event giving rise to the claim.

12. indemnification

you agree to indemnify and hold ddpc harmless from any claim, demand, loss, liability, and expense (including reasonable attorneys' fees) arising out of your breach of these terms, your misuse of the services, or your content.

13. governing law and disputes

these terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules. any dispute arising out of or related to these terms or the services will be resolved exclusively in the state or federal courts located in larimer county, colorado, and you consent to the personal jurisdiction of those courts. nothing in this section prevents either party from seeking injunctive relief for violations of intellectual property rights in any court of competent jurisdiction.

14. changes to the terms

we may update these terms from time to time. if we do, we will update the "last updated" date at the top and, for material changes, notify you by email or by an in-app notice before the change takes effect. your continued use of the services after the change takes effect means you accept the updated terms.
